Dual-use goods and export controls
Dual-use goods are products that have both civilian and military applications — for example, certain chemicals, electronics, software, and machine tools. Exporting them without proper authorization is a serious offense.
How to Know If Your Product Is Dual-Use
Check your country's export control list. In the EU, this is Annex I of the EU Dual-Use Regulation (EU 2021/821). In the US, it is the Commerce Control List (CCL) administered by the Bureau of Industry and Security (BIS). Products are identified by Export Control Classification Numbers (ECCNs).
What You Need to Do
- Classify your product — Determine if it falls under a controlled ECCN or is designated EAR99 (not specifically controlled).
- Check the destination — Some destinations require a license regardless of the product classification.
- Screen the end user — Ensure the buyer is not on any denied parties list.
- Apply for a license if required — Processing times vary from weeks to months.
On Faktorist
When listing products that may be dual-use, the platform prompts you to confirm export control classification. This helps buyers understand any lead-time implications for license processing.
